Claims Against The Estate

Once a probate case is opened for an estate, creditors have the right to make formal claims against the estate. The time limit for creditor claims varies by state, but it is usually a few months after the creditor is notified of the death.  A creditor has 4 months from the date of publication or 1 month from the date they receive actual notice, whichever is later, to present their written claim or it will be barred.
